Terms of Service + Custom Order Terms

These Terms of Service + Custom Order Terms (“Terms”) govern your access to our website and your purchase of products from Litania.

By placing an order through our checkout, submitting a Photo Submission, or using our website, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. Our products are intended for personal consumer purchase and adult jewelry use. They are not intended for children, resale, or use as safety equipment.

2. Definitions

Custom Order means any item made specifically for you using your submitted photo, image, or other personalized input.

Photo Submission means any photograph, image, file, or related content you upload, email, transmit, or otherwise provide to us for use in connection with a Custom Order.

Production Start means the time we send notice that your Photo Submission has been accepted and production is beginning or scheduled to begin within 24 hours.

Material Mismatch means a substantial and outcome-relevant difference between the accepted production basis for your order and the item delivered, excluding minor variation inherent in handmade, cast, or finished goods.

Delivery Confirmation means carrier tracking or similar delivery status showing delivery to the shipping address provided in your order, subject to applicable law.

3. Products and Custom Nature of Goods

Many of our products are Custom Orders made specifically from customer-submitted content and may involve digital review, editing, relief conversion, casting, polishing, finishing, and assembly.

Product photos, renders, mockups, and examples on our website are illustrative. Because each piece is individually produced, minor variation in detail, finish, polish, tone, texture, chain, packaging, and surface characteristics may occur and does not by itself constitute a defect.

4. Prices, Payment, Taxes, and Order Acceptance

Prices are shown in the currency displayed at checkout. Payment is due at the time your order is placed unless we clearly state otherwise.

Shipping charges, taxes, duties, and similar fees may be added as shown at checkout.

Your order is an offer to purchase and remains subject to our acceptance. We may decline, suspend, or cancel an order before Production Start for reasons including suspected fraud, suspected infringement, inability to fulfill, prohibited content, technical or pricing error, or failure to receive a suitable Photo Submission.

5. Photo Submission Requirements

You are responsible for providing a clear, suitable, and usable Photo Submission in the file format and quality we request.

We may reject or request replacement of a Photo Submission that is blurry, incomplete, technically unusable, unlawful, or otherwise unsuitable for production.

Any delay caused by an incomplete or unsuitable Photo Submission may delay review, acceptance, production, and shipping.

6. Your Rights in Submitted Content

You represent and warrant that you own the Photo Submission or have all rights, permissions, and authority necessary to provide it to us and authorize our use of it for your Custom Order.

You further represent and warrant that your Photo Submission, and our use of it as permitted by these Terms, will not infringe or violate any copyright, trademark, privacy, publicity, moral, or other rights of any person or entity, and will not violate any law.

7. Limited License to Litania

You grant Litania a limited, non-exclusive license to use, reproduce, store, modify as reasonably needed for production, and otherwise process your Photo Submission solely to review, design, model, manufacture, fulfill, support, and, where appropriate, repair or remake your Custom Order, and to maintain related support, fraud-prevention, and dispute records during the retention periods described in our Privacy Policy.

Except for this limited license, we do not claim ownership of the underlying Photo Submission.

8. Prohibited Submissions and Refusal Rights

We may refuse, suspend, or cancel any Photo Submission or order that we reasonably believe is unlawful, infringing, threatening, abusive, obscene, technically unusable, unsafe, or otherwise inconsistent with our policies or brand standards.

If we refuse a Photo Submission before Production Start, we may request a replacement image, place the order on hold, cancel the order, or issue a refund where appropriate.

9. Artistic and Manufacturing Interpretation

Your finished piece is a physical artistic and manufacturing interpretation of the accepted Photo Submission. Final appearance may vary based on image quality, crop, lighting, contrast, relief conversion, casting, finishing, and polishing. Minor differences between the source image, any on-screen reference, and the finished piece are expected and do not by themselves establish a defect or Material Mismatch.

10. Photo Acceptance and Production Start

After we receive your order and Photo Submission, we may review the Photo Submission for suitability.

If accepted, we will send notice that your Photo Submission has been accepted and that production is beginning or scheduled to begin within 24 hours. That notice is the point of Production Start.

If we offer an order-specific proof or approval step for a particular order, that order-specific written flow will govern that step, but Production Start still begins only when we send the acceptance/production notice unless we expressly state otherwise in writing.

11. Cancellation

You may request cancellation only before Production Start.

After Production Start, Custom Orders are non-cancellable because design, labor, materials, and manufacturing resources have been committed.

If you do not provide a suitable Photo Submission within 30 days after purchase, we may administratively cancel the order and issue a refund, store credit, or other resolution in our discretion, less any non-recoverable third-party costs if clearly disclosed in advance and permitted by law.

12. Production and Shipping Estimates

Any production or shipping timeframes we provide are estimates unless we expressly state in writing that a date is guaranteed.

Production begins only after Production Start. Transit times are carrier estimates and may vary.

You are responsible for providing a complete and accurate shipping address.

If a material delay occurs before shipment, we may contact you with an updated estimate and available options consistent with applicable law.

13. Delivery, Risk of Loss, and Returned Shipments

Risk of loss passes upon delivery to the address you provided, subject to applicable law.

Delivery Confirmation may be established by carrier tracking, delivery scan, or similar proof.

If a package is returned to us because of an incorrect address, refusal, failure to claim, or similar issue not caused by us, you may be responsible for reshipment charges or other reasonable costs.

14. No General Returns or Exchanges for Custom Goods

Because each Custom Order is made specifically for you, we do not accept general returns or exchanges after Production Start except as described in our Return, Refund, and Remake Policy or where required by law.

15. Remake Requests and Limited Remedies

If your order arrives damaged, contains a manufacturing defect, is the wrong item, or you believe it reflects a Material Mismatch, you must contact us at support@litania.studio within 14 days after Delivery Confirmation and include your order number, a description of the issue, and clear photos showing the claimed problem.

Where appropriate, our primary remedies are repair, remake, or replacement. Refund may be offered at our discretion or where required by law.

We may deny a claim if the issue arises from ordinary handmade variation, a low-quality source image that was accepted for production, normal wear and tear, misuse, accidental damage after delivery, improper care, or information you failed to provide before Production Start.

16. Product Care and Intended Use

Our products are intended as adult jewelry for ordinary personal wear.

Remove jewelry before swimming, bathing, sleeping, sports, operating machinery, or activities where loose jewelry may pose a hazard. Avoid exposure to chemicals, abrasives, and rough handling. Keep away from small children. Discontinue use if irritation occurs.

17. Website Use

You may not misuse the website, interfere with its operation, attempt unauthorized access, upload malicious code, or use the website in violation of law or third-party rights.

All site content, including text, branding, designs, product images, graphics, and site layout, is owned by Litania or its licensors and may not be copied, reproduced, or used without permission except as allowed by law.

18. Disclaimer of Warranties

Except as expressly stated in these Terms or where prohibited by law, our website, products, and services are provided “as is” and “as available,” and we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

19. Limitation of Liability

To the maximum extent permitted by law, Litania will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost opportunity, emotional distress, or data loss arising out of or relating to any order, product, website use, or Photo Submission.

To the maximum extent permitted by law, Litania’s total liability for any claim relating to a specific order will not exceed the amount you paid to Litania for that order.

Nothing in these Terms excludes liability that cannot legally be excluded.

20. Indemnity

You agree to indemnify, defend, and hold harmless Litania and its managers, members, employees, contractors, service providers, and affiliates from and against claims, liabilities, damages, losses, and expenses arising out of or related to your Photo Submission, your breach of these Terms, or your violation of any law or third-party rights.

21. Contact Before Payment Dispute

If you have a concern about your order, you agree to contact us first and give us a reasonable opportunity to review and, where appropriate, resolve the issue before initiating a chargeback or similar payment dispute.

22. Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except where consumer law in your jurisdiction requires otherwise.

Any dispute relating to these Terms or an order will be brought exclusively in the state or federal courts located in Sheridan, WY, unless another dispute process is lawfully adopted and clearly presented to you.

23. Changes to These Terms

We may update these Terms from time to time for future orders by posting an updated version with a new Effective Date. The Terms in effect at the time of your order will apply to that order unless law requires otherwise.

24. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect.

Our failure to enforce any provision is not a waiver.

These Terms, together with any order-specific written communication, our Return, Refund, and Remake Policy, our Shipping Policy, and our Privacy Policy, form the entire agreement relating to your order except where additional terms are expressly incorporated.
